India's stand on intellectual property rights (IPRs) and pharma issues in proposed trade agreements balances innovation with public health needs, ensures availability of affordable medicines and promotes growth of generic medicine industry, a GTRI report said on Friday. Think tank Global Trade Research Initiative (GTRI) said that by opposing demands of developed nations on issues like 'data exclusivity' and 'patent linkage' in free trade agreements (FTAs), India ensures that generic drug manufacturers get greater market access and cost of life-saving medicines gets reduced significantly.

The Delhi Commercial Court issued a significant ruling in favour of Monster Energy Company in its ongoing trademark infringement case against Shree Parvati Fitness Hub Private Limited. The court granted an interim injunction, restraining the defendants from using the "Monster" trademark and related branding for food and protein supplements.

In a significant development, the District Commercial Court in Tis Hazari, Delhi, has ruled in favour of KDH Food (OPC) Pvt. Ltd., the proprietor of the renowned trademark "Kake Di Hatti." The court has restrained Amir Khan, the franchisee and respondent in the case, from continuing to operate a food business under the disputed trademark.

In a working paper on ‘India and Global IPR Treaties,’ Sanjeev Sanyal, a member of the Economic Advisory Council to the PM, urged India to shift from a defensive to an offensive stance on Intellectual Property Rights (IPR). He emphasized the need for India to sign key international IPR agreements to foster a stronger research and development (R&D) ecosystem and align with global best practices.
