


The Delhi High Court has recognised “TAJ” as a well-known trademark, granting it protected status in the hospitality sector. The Indian Hotels Company Limited (IHCL) filed a lawsuit against individuals accused of misusing the brand. The court cited evidence of IHCL’s global recognition, historical significance, and brand reputation.
The Delhi High Court has officially recognised “TAJ” as a well-known trademark under Section 2(1)(zg) of the Trademarks Act, granting it protected status for hotels and related services in the hospitality sector. This ruling comes in response to a lawsuit filed by the Indian Hotels Company Limited (IHCL), part of the TATA Group, against several individuals accused of trademark infringement and copyright violations.
IHCL’s legal action stems from allegations that these individuals misrepresented their services as being associated with the renowned IHCL brand. The company, a leader in the hospitality industry, operates around 350 hotels globally, with 118 more under development across 4 continents and 13 countries. IHCL is also noted as South Asia’s largest hospitality firm by market capitalisation and is publicly traded on the Bombay Stock Exchange and National Stock Exchange.
Justice Amit Bansal’s bench ruled that IHCL has provided sufficient evidence to establish “TAJ” as a well-known trademark. The court cited various factors that showcased the brand’s long-standing use, extensive reach, public recognition and strong goodwill both in India and internationally.
The ruling also highlighted that the “VIVANTA” mark, another brand under IHCL, was previously declared a well-known trademark in September 2022. To support its case, IHCL presented numerous documents, including Brand Finance reports naming “TAJ” as India’s strongest brand in 2020, 2022, and 2023.
The court considered historical photographs featuring prominent figures like Mahatma Gandhi and Jawaharlal Nehru at the iconic Taj Mahal Palace in Mumbai, as well as media coverage from 2009 to 2015 that demonstrated the brand’s fame. Additionally, IHCL’s corporate social responsibility efforts and its active social media presence were noted as further evidence of the brand’s prominence.
